You only have a limited amount of time to take legal action in many cases involving medical malpractice or a birth injury in Ohio. In most instances, you only have one year to file a lawsuit or take other legal action in Ohio in cases involving medical malpractice or a birth injury, according to Ohio Revised Code § 2305.113.
In cases involving wrongful death, the deadline (known as the statute of limitations) to take legal action in Ohio is generally two years from the date of the person’s death, according to Ohio Revised Code § 2152.02(D).
However, in certain circumstances, these deadlines in Ohio can sometimes be extended to four years to file a lawsuit or take other legal action. This is due to what's known as the “medical malpractice statute of repose,” according to Ohio Revised Code § 2305.113(C).
In addition, there are sometimes exemptions that can extend certain deadlines and give families more time to take legal action. This is especially true in cases involving minors (children under 18 years old) in which a birth injury or delayed development due to a disability is not discovered right away, according to Ohio Revised Code § 2305.16.
